Welcome to Pubbo. These Terms of Service (the “Terms”) govern your access to and use of our official online store at www.pubbo.ai (the “Website”), including purchases made through the Website. The Website is operated for online sales by Shanghai WhalesBot Technology Co., Ltd. (referred to in these Terms as “Pubbo,” “we,” “us,” or “our”).
By accessing the Website or placing an order, you agree to these Terms to the extent permitted by applicable law. Please read them alongside the policies referenced below. The Pubbo App, hardware features, and other connected services may also be subject to separate Product/App Terms and applicable privacy notices.
1. Website Use and General Conditions
You agree to use the Website only for lawful purposes and not to interfere with its operation, security, or other users. We may decline or cancel orders for legitimate reasons, including suspected fraud, material pricing errors, unlawful activity, or lack of inventory, subject to applicable law and our refund obligations.
2. Eligibility, Children, and Parental Involvement
Purchases on the Website must be made by an adult who has reached the age of majority in their jurisdiction. Pubbo is a child-oriented product with a recommended product age of 6 years and above, subject to the safety instructions included with the product.
We recommend that a parent or legal guardian register and manage the relevant account and that children use the device with age-appropriate parental supervision. Any specific account eligibility, parental authorization, and consent requirements for the App or connected services are described in the applicable Product/App Terms and Privacy Policy.
3. Products, Content, and Availability
We endeavor to display product descriptions, images, features, compatibility information, pricing, and availability accurately. Minor visual differences may occur, and product specifications or availability may change. We may correct material errors and update listings, without improperly affecting rights arising from orders already accepted.
4. Orders, Pricing, and Payments
Unless otherwise stated, prices on the Website are shown in U.S. dollars (USD). Available promotions, applicable sales taxes, and any optional delivery charges will be disclosed at checkout before payment. We do not charge a separate import-duty or customs-clearance fee upon delivery under our current U.S. fulfillment arrangement.
An order confirmation acknowledges receipt of your order, but does not necessarily mean the order has been accepted or dispatched. If an order is cancelled after payment is collected, we will issue the applicable refund in accordance with our Return & Refund Policy and applicable law. Payments are handled by the payment methods made available at checkout.
5. Shipping and Delivery
We currently ship only to the contiguous 48 U.S. states, excluding Alaska, Hawaii, U.S. territories, international destinations, P.O. Boxes, and APO/FPO/DPO addresses.
- Standard Shipping: free on eligible orders; delivery typically within 7 business days after order placement.
- Fast Shipping: $10 per order; delivery typically within 2–3 business days after order placement.
- Complimentary Fast Shipping: available for orders with a merchandise subtotal of $500 or more after discounts, before taxes and shipping.
Orders are typically processed in 1–2 business days. Delivery times above are estimates beginning at order placement and include normal processing. Multiple carriers and logistics partners may be used. For shipping destinations, delivery changes, tracking, delays, and carrier-related issues, please refer to our Shipping Policy available on the Website.
6. Returns, Refunds, and Hardware Warranty
Eligible purchases from our official online store may be returned within 30 calendar days after delivery under our Return & Refund Policy. After a return is approved and instructions are provided, the product must generally be handed to the carrier within 7 calendar days. Customers are responsible for return shipping on approved change-of-mind returns; Pubbo covers approved return and replacement shipping costs for verified defects, damage in transit, or fulfillment errors.
For returned products requiring inspection, approved refunds are issued to the original payment method within 7 business days after delivery to our designated U.S. return warehouse, with inspection normally taking 3–5 business days within that period. Additional bank or payment-provider posting time may apply.
Eligible manufacturing defects are covered by our one-year limited hardware warranty. Our hardware warranty service is replacement-only: after authorization, return, and verification, we send a new replacement unit instead of repairing the original device. See our Return & Refund Policy and any separately provided Limited Warranty terms for full conditions. Nothing in these Terms limits non-waivable consumer rights.
7. Pubbo App, Activation, and Connected Features
The Pubbo App can be downloaded through the Apple App Store for compatible iOS devices and through Google Play for compatible Android devices, subject to availability and device compatibility. For device activation, follow the product user manual or the Quick Start Guide included in the packaging after purchase.
Some AI-powered, creative, educational, or connected features may require an internet connection, account registration, software updates, or additional steps described in the product instructions. The use of the App and connected services is also governed by the existing applicable Product/App Terms. If there is a conflict regarding operation of App features, the provisions governing those specific features apply to the extent permitted by law, without changing the purchase, return, and warranty commitments made through the Website.
8. AI-Generated Content and Sharing
Where the applicable feature offers such functionality, users may download and share images or other creative output generated using Pubbo, subject to applicable law, the rights of third parties, and the applicable Product/App Terms. We do not guarantee that AI-generated content will be unique, accurate, or free of third-party claims.
9. Accounts and Security
Where an account is needed, the person creating or managing that account should provide accurate information, safeguard login credentials, and notify us if unauthorized access is suspected. We recommend that parents or guardians manage accounts used with a child’s device. Specific account functions and procedures are governed by the applicable Product/App Terms.
10. Privacy and Children’s Information
Our Privacy Policy covers data practices relating to the official Website, the Pubbo hardware device, and the Pubbo App. Please review it for information about the collection, use, protection, and management of personal information, including information associated with children and connected features.
Additional notices, parental authorization, or consent procedures may be required for specific functions under applicable law. Nothing in these Terms substitutes for any legally required parental notice or consent. The Privacy Policy is available through the Website’s published policy links.
11. Intellectual Property and Website Materials
Pubbo and its licensors retain their respective rights to trademarks, product names, logos, designs, images, text, website content, and other proprietary materials. Subject to applicable law, you may view and use Website materials for personal, non-commercial purposes in connection with considering or using Pubbo products. You may not reproduce or exploit proprietary Website content commercially without authorization.
Rights related to user-supplied material and AI-generated content may be addressed separately in the Product/App Terms.
12. Prohibited Activities
You must not use the Website or related services to break the law; infringe others’ rights; upload harmful code; obtain unauthorized access to accounts or systems; interfere with service security; or threaten, exploit, harass, or endanger children or other people. We may take proportionate action against material violations where permitted by law.
13. Third-Party Services and Links
The Website and related checkout or support functions may involve third-party providers, such as payment processors, shipping carriers, app stores, and technology partners. Separate third-party terms may apply to those providers. Links to external sites do not imply our endorsement. Nothing in this section changes our obligations concerning orders and services that we provide directly.
14. Availability, Updates, and AI Limitations
We may maintain or update the Website and connected services to support reliability, security, and new functionality. Temporary interruptions or feature changes may occur. Material changes affecting paid or promised features will be handled in accordance with applicable law and commitments made to customers.
AI-generated answers can be incorrect, incomplete, or unexpected. Pubbo’s AI features are intended for play, creativity, companionship, and learning activities. They are not substitutes for emergency assistance or professional medical, mental health, legal, or other advice. Parents and guardians should provide appropriate supervision.
15. Disclaimers and Liability
We take reasonable steps to maintain the Website and provide accurate information; however, uninterrupted or error-free Website operation cannot be guaranteed. To the extent permitted by applicable law, liability may be limited for losses caused by circumstances outside our reasonable control.
Nothing in these Terms limits any express product warranty, rights under the Return & Refund Policy, non-excludable statutory warranties or protections, or any liability that cannot legally be restricted.
16. Governing Law and Dispute Resolution
These Terms and any disputes arising out of or relating to use of the Website or purchases made directly through www.pubbo.ai shall be governed by and construed in accordance with the laws of the People’s Republic of China (excluding, for the purposes of this provision, the laws of the Hong Kong and Macao Special Administrative Regions and Taiwan), to the extent permitted by applicable law. This choice of law does not deprive consumers of any mandatory protections or non-waivable rights that apply in their place of residence, including those applicable to U.S. customers.

If the matter cannot be resolved, claims may be brought before a court having jurisdiction under applicable law. These Terms do not require mandatory arbitration or designate an exclusive court or forum.
17. Changes to These Terms
We may revise these Terms to reflect changes in the Website, business operations, or applicable legal requirements. Updated terms will be posted with a new effective date. Where required by law, we will provide additional notice or request consent. Revisions will not retroactively remove rights associated with purchases already completed.
